Rhode Island voluntary informal administration: the $15,000 estate limit

Rhode Island offers voluntary informal administration when property subject to the probate inventory does not exceed $15,000, using a Probate Court appointment rather than a self-executing bank affidavit.

Value the property that belongs on the probate inventory. The local Probate Court decides whether the petition and proposed distribution fit chapter 33-24; do not assume the dollar figure alone authorizes collection.

Check eligibility before signing

  • Inventory property is $15,000 or less.
  • The petitioner is entitled to seek appointment.
  • The will and family information can be presented to the Probate Court.
  • The estate can be paid and distributed through the informal process.

Gather the required documents

  • Petition for voluntary informal administration
  • Certified death certificate
  • Original will, if any
  • Inventory and valuation
  • Heir and beneficiary information
  • Bond or waiver if the Probate Court requires it

Follow the state procedure

File in the municipal Probate Court with jurisdiction. The court appoints the voluntary administrator and issues authority to collect assets; the administrator then pays proper expenses and claims and reports or distributes as the court directs.

Know which property the shortcut reaches

Only property within the qualifying probate inventory is administered in this case. Questions about real-estate title, a disputed will, or property outside the inventory can require ordinary probate.

Understand the recipient's responsibility

The voluntary administrator is a court-appointed fiduciary, not merely an account recipient. The administrator must safeguard property, pay lawful charges in order, distribute correctly, and answer for a deficient or inaccurate inventory.

Use another route when these facts apply

  • Inventory property exceeds $15,000.
  • The estate cannot pay priority expenses and claims as proposed.
  • Heirs, beneficiaries, or the will are disputed.
  • The Probate Court requires regular administration.
