The threshold covers the estate subject to administration rather than only the account being collected. Real estate is outside the affidavit even if the estate's net value is below the ceiling.
Check the net estate and administration status
Value the probate estate and subtract liens and encumbrances. The successor must be entitled to the property and able to state that no personal-representative application is pending or granted.
- Net estate subject to administration is $100,000 or less.
- At least 30 days have elapsed.
- No personal representative is pending or appointed.
- The claimant is the successor entitled to the asset.
Present the statutory affidavit
Give the debtor or property holder an affidavit stating the value test, elapsed time, absence of administration, and entitlement. A securities registrar may rely on the same statutory collection authority for a transfer or registration.
Collect personal property, not land
The chapter covers personal property and debts owed to the decedent. North Dakota real property needs probate or another valid title-transfer device, such as a recorded transfer-on-death deed when one was completed during life.
The successor remains accountable
A holder who transfers in reliance on a compliant affidavit receives statutory protection, but the successor is answerable to a later personal representative and to other people with superior rights. The shortcut does not decide a contested inheritance.
Do not confuse affidavit collection with summary administration
Section 30.1-23-03 provides a separate closing procedure for an appointed personal representative when estate value is absorbed by allowances, expenses, and claims. It is not the same $100,000 affidavit route.
