Check eligibility before signing
- At least 30 days have passed.
- Net probate personal property is $100,000 or less.
- No personal representative is pending or appointed.
- The claimant is a successor entitled to the property.
Gather the required documents
- Affidavit containing the section 30-24,125 statements
- Certified death certificate
- Proof of identity and successor status
- Account, security, vehicle, or asset records
- Separate title forms required by the asset holder
Follow the state procedure
Present the sworn affidavit to each debtor or holder. A securities registrar may rely on the companion statute to transfer or register securities without requiring letters from a probate court.
Know which property the shortcut reaches
This affidavit collects personal property and debts owed to the decedent. Nebraska has a separate affidavit mechanism for qualifying real property; do not use the personal-property form as a deed.
Understand the recipient's responsibility
The recipient is answerable to a later personal representative and to successors with a superior claim. Holder protection shifts the risk of a false or incomplete affidavit to the person who signed and received the property.

- Net personal property exceeds $100,000.
- A probate appointment is pending or complete.
- Real property needs transfer under the separate statute.
