Missouri's $40,000 small-estate affidavit: when creditor publication is required

Missouri permits a distributee to seek refusal of letters and collect a net estate of $40,000 or less after 30 days. When the estate exceeds $15,000, the distributee must complete the statutory newspaper notice to creditors.

Value the estate less liens, debts, and encumbrances using section 473.097. The $15,000 notice trigger is separate from the $40,000 ceiling and cannot be skipped because all known family members agree.

Check eligibility before signing

  • At least 30 days have passed.
  • Net estate value is $40,000 or less.
  • No letters have been issued and no application is pending.
  • The distributee can list property, debts, and everyone entitled.

Gather the required documents

  • Affidavit for collection of a small estate
  • Certified death certificate
  • Original will, if any
  • Itemized property, liens, and debts
  • Heir or devisee names and shares
  • Newspaper proof of publication when value exceeds $15,000

Follow the state procedure

File the affidavit with the probate division and obtain the clerk's certificate. Complete creditor publication when triggered, observe the claims period, collect under certified authority, and distribute only after proper debts and expenses are addressed.

Know which property the shortcut reaches

The order can cover qualifying estate assets listed in the filing, but land-title transfers require an accurate legal description and recording. Non-probate property is not pulled into the estate by the affidavit.

Understand the recipient's responsibility

The distributee is liable to valid claimants and other distributees to the extent of property received. Missing the publication step can preserve claims that the filer expected the shortcut to cut off.

Use another route when these facts apply

  • Net estate value exceeds $40,000.
  • The required creditor publication is not completed.
  • Letters are pending or issued.
  • Title, will, heirship, or insolvency disputes require administration.
