Mississippi's $75,000 small-estate affidavit: personal property after 30 days

Mississippi lets a successor collect personal property by affidavit after 30 days when the estate, less liens and encumbrances, does not exceed $75,000 and no estate administration is pending.

Count the whole probate personal estate and subtract liens and encumbrances. Do not treat real estate or a non-probate beneficiary asset as though it were an account collected under section 91-7-322.

Check eligibility before signing

  • At least 30 days have passed.
  • Net probate personal property is $75,000 or less.
  • No petition for a personal representative is pending or granted.
  • The affiant is a successor entitled to the property.

Gather the required documents

  • Section 91-7-322 successor affidavit
  • Certified death certificate
  • Asset values and lien statements
  • Proof of identity and successor status
  • Institution-specific account, vehicle, or security forms

Follow the state procedure

Deliver the affidavit to the debtor or property holder. A holder that relies on the sworn statements may pay or transfer without requiring letters of administration.

Know which property the shortcut reaches

The affidavit reaches personal property and debts owed to the decedent. Mississippi land passes through probate, a will admitted as muniment of title, a valid transfer-on-death deed, or another land-title method.

Understand the recipient's responsibility

The successor receives subject to a later representative and superior claimants and must distribute correctly. A false affidavit or wrongful retention can result in personal liability for the property or its value.

Use another route when these facts apply

  • Net personal property exceeds $75,000.
  • Real property needs transfer.
  • Administration is pending or open.
  • Successor or creditor rights are contested.
