Kentucky's $30,000 dispense-with-administration procedure

Kentucky can dispense with formal administration when qualifying personal property or money fits within the $30,000 exemption for a surviving spouse or, if none, the decedent's children.

This is an exemption-based court procedure, not a general $30,000 affidavit for any claimant. Identify the surviving spouse or eligible children and value the personal property or funds requested in the petition.

Check eligibility before signing

  • A surviving spouse claims the statutory exemption, or eligible children claim when no spouse survives.
  • The requested personal property or money fits within $30,000.
  • The petitioner can document funeral expenses and estate assets.
  • No issue requires appointment of a regular fiduciary.

Gather the required documents

  • Petition to Dispense with Administration (AOC-830)
  • Certified death certificate
  • Original will, if any
  • Funeral bill and payment information
  • Asset values and account statements
  • Heir information and required waivers

Follow the state procedure

File the petition in District Court. The judge reviews the exemption, funeral expenses, and requested property and may enter an order directing transfer without appointing a regular personal representative.

Know which property the shortcut reaches

The order sets apart qualifying personal property or money. It does not function as a general deed for real estate or resolve a contested title interest.

Understand the recipient's responsibility

The petitioner must use property consistently with the court order and remains responsible for truthful asset, family, and expense disclosures. An improper transfer can be challenged by creditors or other entitled people.
