Idaho's $100,000 small-estate affidavit: the 30-day collection rule

Idaho lets a successor collect personal property after 30 days when the probate estate, less liens and encumbrances, does not exceed $100,000 and no personal representative is pending or appointed.

Count the entire probate estate for the statutory value statement, not just the account being collected, and subtract liens and encumbrances. The collection section reaches personal property rather than land.

Check eligibility before signing

  • At least 30 days have passed.
  • The net probate estate is $100,000 or less.
  • No personal representative is pending or appointed.
  • The claimant is a successor entitled to the property.

Gather the required documents

  • Idaho Code 15-3-1201 affidavit
  • Certified death certificate
  • Asset values and lien information
  • Proof of identity and successor status
  • Security, vehicle, or account transfer forms

Follow the state procedure

Present the affidavit to the debtor or holder. The companion securities provision permits a registrar to transfer qualifying securities on the same successor showing.

Know which property the shortcut reaches

The affidavit collects personal property and debts owed to the decedent. Idaho real property requires probate, a recorded transfer-on-death deed, or another valid title mechanism.

Understand the recipient's responsibility

The recipient is answerable to a later personal representative and anyone with a superior right. Holder protection does not excuse a false value, omitted successor, or misuse of the asset.

Use another route when these facts apply

  • Net probate value exceeds $100,000.
  • The estate includes real property needing transfer.
  • A representative is pending or appointed.
  • Successor rights or claims are contested.
