Alaska's small-estate affidavit: separate vehicle and personal-property limits

After 30 days, Alaska permits affidavit collection when registered vehicles total no more than $100,000 and other personal property does not exceed $50,000. The estate cannot include real property for this affidavit route.

Keep registered vehicles in their own statutory bucket and count other personal property separately. Do not combine the two figures into a single unrestricted ceiling.

Check eligibility before signing

  • At least 30 days have passed.
  • Registered vehicles total $100,000 or less.
  • Other personal property totals $50,000 or less.
  • No personal representative is pending or appointed and no real property is included.

Gather the required documents

  • AS 13.16.680 successor affidavit
  • Certified death certificate
  • Vehicle titles and valuations
  • Statements for other personal assets
  • Proof of identity and successor status
  • Division of Motor Vehicles transfer forms

Follow the state procedure

Present the affidavit to each holder and use the required DMV papers for registered vehicles. A bank, debtor, or registrar may transfer qualifying property without letters when the sworn conditions are complete.

Know which property the shortcut reaches

The affidavit reaches registered vehicles and other personal property within their separate caps. Alaska real estate requires summary administration, probate, or a valid transfer-on-death deed recorded during life.

Understand the recipient's responsibility

The successor is answerable to a later personal representative and other entitled people. A holder may rely on the affidavit, so inaccurate asset classification or entitlement can create personal exposure.

Use another route when these facts apply

  • Either separate value limit is exceeded.
  • The estate contains real property.
  • A representative is pending or appointed.
  • Successor, title, or creditor rights are disputed.
