Alabama's indexed small-estate petition: no land and a 30-day notice period

Alabama's revised small-estate procedure permits probate-court summary distribution when the estate owns no real property and stays within the indexed amount, currently $47,000, after the required 30-day notice period.

Use the Comptroller's current indexed amount and include the probate personal estate as the Act directs. The presence of any probate real property disqualifies the summary-distribution petition.

Check eligibility before signing

  • The estate owns no real property.
  • Probate personal property is within the current indexed amount.
  • The petitioner has statutory priority or required consent.
  • The estate can complete the 30-day notice and payment process.

Gather the required documents

  • Petition for summary distribution under the Revised Alabama Small Estates Act
  • Certified death certificate
  • Original will, if any
  • Current Comptroller valuation notice
  • Itemized personal property and debts
  • Heir, devisee, and creditor notice information

Follow the state procedure

File in probate court. The court issues the statutory notice, allows the 30-day response period, and may order summary distribution after priority expenses, claims, and successor rights are addressed.

Know which property the shortcut reaches

The procedure handles qualifying personal property only. Any Alabama land in the probate estate requires ordinary administration or another valid title route.

Understand the recipient's responsibility

A petitioner and recipient must follow the court's order and remains accountable for omitted assets, creditors, or successors. The indexed ceiling and notice process are conditions, not optional form language.

Use another route when these facts apply

  • The decedent owned probate real property.
  • The current indexed amount is exceeded.
  • Notice produces a disputed creditor or successor claim.
  • The estate needs a fiduciary to litigate, sell, or manage assets.
